Paint Now, Pay After Sale – Terms & Conditions

Program Overview Under the “Paint Now, Pay After Sale” promotion, St. Pete Exterior Painting will complete the agreed-upon exterior painting services with $0 due upfront. Payment in full is deferred until one of the following occurs:

  • The property sells and closes, or

  • 180 calendar days pass from the date of final payment invoice (whichever happens first).

Payment Obligation You (the property owner at the time of service) remain fully and personally responsible for the total agreed-upon price of the services, regardless of:

  • Whether the property sells within 180 days

  • Whether the property sells at all

  • Any change in ownership (sale, transfer, gift, inheritance, foreclosure, etc.)

  • Any delay, failure, or cancellation of a pending sale

  • Any financing issues, buyer contingencies, title problems, or closing delays

  • Any decision not to list or sell the property

Payment Due Date The full balance becomes due and payable no later than 180 calendar days after the date we issue the final invoice (typically the day the job is completed and signed off). If the property closes and funds are available before day 180, payment is due within 5 business days of closing. We will accept payment via check, bank transfer, credit card, or cash.

Late Payments & Collection Fees Any balance unpaid after the due date will be subject to:

  • Late fees of 2.5% per month (30% APR), and

  • If we are required to file in Small Claims Court, you agree to pay an additional collection fee of 25% of the total job price.

You are also responsible for all reasonable collection costs, court fees, and attorney fees incurred by us.

No Contingencies This is not a contingency-based or conditional payment plan. The deferred payment is a courtesy offered in good faith to help facilitate a sale. It does not create any obligation on our part to guarantee a sale, sale price, timeline, or any real estate outcome.

Lien Rights We reserve the right to file a mechanic’s lien (construction lien) against the property if payment is not received by the due date, as permitted under Florida law (Chapter 713, Florida Statutes). Filing a lien does not waive any other remedies.

Changes in Ownership If ownership changes before full payment is made (via sale, transfer, refinance, etc.), the original owner remains liable for the full amount. The new owner is not automatically responsible unless they explicitly assume the debt in writing.

Cancellation / Early Termination If you cancel the sale plan or decide not to sell, the full balance is still due on day 180. There are no refunds or credits for early payment or non-sale.

Acceptance By signing the service agreement or work order that references this promotion, you acknowledge that you have read, understand, and agree to these terms. These terms are binding and cannot be modified verbally—any changes must be in writing and signed by both parties.
